TERMS & CONDITIONS OF FLAMENCO BEACH CLUB SERVICES AND RENTALS

Cabana Setup Service

Flamenco Beach Club offers a beach cabana setup service exclusively for registered guests of Culebra Beach Villas and Day Guests at Culebra Beach Villas,  by advance reservation only.

Cabana setups are placed in the beach area adjacent to Culebra Beach Villas at Flamenco Beach. Specific placement may vary based on weather conditions, beach conditions, environmental regulations, occupancy levels, or operational requirements.

Flamenco Beach Club reserves the right to relocate, modify, delay, or cancel any cabana setup if weather, wind conditions, environmental restrictions, safety concerns, government regulations, or other circumstances beyond our control make operation unsafe or impractical.

Cabana Setup and Removal Schedule

Cabana setups are provided as a daily service and are available only during operating hours.

All cabanas are set up exclusively in the beach area adjacent to Culebra Beach Villas at Flamenco Beach. Cabana services are NOT provided at the public Flamenco Beach Balneario, camping area, public parking area, kiosks, or any other location outside the designated Culebra Beach Villas beach area.

• Cabana setups will be completed by approximately 9:30 AM on the reservation date.
• Cabana service concludes at 4:00 PM, at which time our team will begin removing cabanas and related equipment from the beach.
• Guests are responsible for removing all personal belongings from the cabana area prior to pickup.
• Flamenco Beach Club is not responsible for personal items left behind after cabana removal.
• Setup and removal times may vary due to weather conditions, beach conditions, operational requirements, environmental regulations, or circumstances beyond our control.

Please note that cabanas are not available for overnight use and may not remain on the beach after operating hours. Flamenco Beach is located within a protected natural reserve and sea turtle nesting area, requiring all temporary structures and equipment to be removed daily.

Assumption of Risk

Guest acknowledges that participation in beach and ocean activities involves inherent risks, including but not limited to:

• Drowning
• Strong currents and changing ocean conditions
• Waves and surf-related injuries
• Sun exposure, heat exhaustion, and dehydration
• Falling objects caused by wind
• Marine life encounters
• Slips, trips, and falls
• Weather-related hazards
• Injuries resulting from the use of beach equipment

Guest represents that they and all members of their party are physically capable of safely participating in beach and ocean activities and will exercise reasonable care while using the cabana and surrounding beach area.

No Lifeguard on Duty

Guest understands and acknowledges that there are no lifeguards on duty at Culebra Beach Villas, Flamenco Beach, or in the surrounding beach areas.

All swimming, snorkeling, beach activities, and ocean activities are undertaken entirely at the Guest's own risk.

Parents and guardians are solely responsible for supervising minors at all times.

Release of Liability

To the fullest extent permitted by law, Guest voluntarily assumes all risks associated with the use of the cabana setup service, beach equipment, beach access, and ocean activities.

Guest agrees to release, waive, discharge, indemnify, and hold harmless:

• Paradise Island LLC
• Stay in Culebra
• Flamenco Beach Club
• Culebra Beach Villas, Corp.
• Their owners, officers, directors, employees, contractors, agents, affiliates, and representatives

from any and all claims, demands, causes of action, liabilities, losses, damages, injuries, illnesses, death, expenses, costs, or attorney's fees arising from or related to the use of the cabana setup service, beach equipment, beach access, ocean conditions, weather conditions, or participation in any beach-related activity.

This release applies regardless of whether the claim arises from ordinary negligence and shall survive the completion of the rental period.

Responsibility for Damages

Guest accepts full responsibility for any damage caused by themselves, members of their party, invitees, children, or guests.

Guest agrees to reimburse Paradise Island LLC and/or Flamenco Beach Club for the repair or replacement cost of any damaged, lost, stolen, or destroyed equipment, furnishings, or property.

Any damage caused to third parties or third-party property shall be the sole responsibility of the Guest.

Environmental Protection Notice

Flamenco Beach is located within a protected natural reserve and sea turtle nesting area.

Guests agree not to relocate, abandon, damage, or leave equipment unattended outside the designated cabana area.

Guests must comply with all applicable regulations established by the Puerto Rico Department of Natural and Environmental Resources (DRNA) and any other governmental authority.

Any fines, penalties, citations, or enforcement actions resulting from the Guest's conduct shall be the sole responsibility of the Guest.

CANCELLATION POLICY

Because cabana setups require advance scheduling, staffing, transportation, and preparation, cancellations must be made at least 14 days prior to the reservation date to receive a full refund.

No refunds will be issued for cancellations made less than 14 days before the reservation date.

No refunds will be issued for:

• Weather conditions
• Ocean conditions
• Sargassum (seaweed)
• Rain
• Wind
• Heat
• Personal schedule changes
• Transportation delays
• Ferry or flight disruptions
• Early departure
• Failure to use the reserved service

Refunds will only be issued if Flamenco Beach Club determines that conditions make it impossible for us to safely provide the reserved cabana service.

In such cases, Flamenco Beach Club may, at its sole discretion, provide a full refund, partial refund, service credit, or reschedule the reservation.

Multi-day Beach Package Rentals

This Agreement is between you, the “Renter,” and Flamenco Beach Club, for the rental of beach equipment and related guest services provided exclusively to registered guests staying at Culebra Beach Villas, located at Flamenco Beach, Culebra, Puerto Rico.

Flamenco Beach Club is a private beach gear rental service created for the convenience of Culebra Beach Villas guests. This service is not available at the public Flamenco Beach balneario, kiosks, parking area, camping area, or for the general public.

By placing an order through FlamencoBeachClub.com, the Renter agrees to the following terms and conditions.

1. Guest Eligibility

Flamenco Beach Club rentals are available only to guests with an active reservation at Culebra Beach Villas.

The Renter may be required to provide their villa/unit number, reservation name, check-in date, and check-out date to verify eligibility.

Orders placed by non-guests or for locations outside Culebra Beach Villas may be cancelled and refunded, minus any applicable processing fees.

2. Reservations and Payment

All reservations must be completed online through FlamencoBeachClub.com, unless otherwise approved.

Full payment is required before any rental equipment is delivered or made available.

Accepted payment methods may include major credit cards, Stripe, PayPal, or other payment options available at checkout.

By submitting payment, the Renter confirms they have read, understood, and agreed to these Terms & Conditions.

3. Delivery and Pickup

Rental items are delivered only to the guest’s assigned unit or designated delivery area within Culebra Beach Villas.

The Renter is responsible for making sure the correct villa/unit information is provided.

Pickup will be scheduled according to the rental period selected. All items must be returned or made available for pickup in the same condition received.

Flamenco Beach Club is not responsible for delays caused by incorrect unit information, restricted access, weather, ferry delays, island-wide outages, or other circumstances beyond our control.

4. Cancellations and Refunds

Orders cancelled before delivery may be eligible for a refund, minus any applicable processing fees.

Once rental equipment has been delivered, no refunds will be issued.

No refunds will be provided for early departure, unused items, weather conditions, beach closures, power outages, water outages, ferry delays, or changes in guest plans.

Refunds, when applicable, will be processed within 7 business days.

5. Equipment Condition

Rental items may be new or gently used.

Brands, colors, styles, and models may vary from website photos, but items will be comparable in function and quality.

Photos shown on the website are for illustrative purposes only.

6. Responsible Use Of Rental Equipment

The Renter agrees to use all rented equipment only for its intended purpose and to handle all items with reasonable care.

The Renter is responsible for all rented equipment from the time it is delivered until it is returned or retrieved by Flamenco Beach Club.

Rental equipment may not be transferred to another person, relocated outside of Culebra Beach Villas or Flamenco Beach, used for commercial purposes, or modified in any way.

The Renter agrees to take reasonable precautions to prevent damage, theft, loss, or excessive wear of all rented items.

Natural Reserve Protection & Overnight Beach Storage Prohibited

Flamenco Beach is located within a protected natural reserve and serves as an important nesting habitat for sea turtles and other native wildlife.

In accordance with environmental protection guidelines and local regulations, all rental equipment, including but not limited to beach chairs, umbrellas, cabanas, coolers, and other beach gear, must be removed from the beach at the end of each day.

Rental equipment may not be left unattended or stored overnight on Flamenco Beach under any circumstances.

The Renter agrees to return all rented items to their assigned villa/unit or designated storage location at the conclusion of each day's use unless otherwise instructed by Flamenco Beach Club.

The Renter acknowledges that leaving equipment unattended or overnight on the beach may result in citations, fines, confiscation of equipment, or other enforcement actions by the Puerto Rico Department of Natural and Environmental Resources (DRNA) or other governmental authorities.

Any fines, penalties, citations, legal fees, confiscations, or related costs arising from the Renter's failure to comply with these requirements shall be the sole responsibility of the Renter.

Flamenco Beach Club shall not be responsible for any equipment that is lost, stolen, damaged, confiscated, or removed after being left unattended or overnight on the beach. The Renter agrees to reimburse Flamenco Beach Club for the full replacement value of any such equipment.

For the protection of wildlife, nesting sea turtles, and the natural environment, Flamenco Beach Club reserves the right to retrieve, relocate, or remove any rental equipment found unattended, improperly secured, or left overnight on the beach without prior notice.

7. Damage, Loss, Theft, or Failure to Return

The Renter is responsible for any lost, stolen, damaged, or unreturned equipment.

Flamenco Beach Club reserves the right to charge the payment method on file for repair, excessive cleaning, or replacement costs.

Normal wear from ordinary beach use is expected. However, excessive sand, stains, tears, broken parts, burns, rust from neglect, missing pieces, or misuse may result in additional charges.

If items are not returned or made available for pickup by the agreed time, additional daily rental fees may apply.

8. Assumption of Risk and Liability Waiver

The Renter understands that using beach equipment involves inherent risks, including injury, property damage, wind-related hazards, ocean conditions, and accidents.

By accepting these Terms, the Renter voluntarily assumes all risks related to the use, transport, setup, and storage of rented equipment.

Flamenco Beach Club provides rental items “as-is” and makes no warranties regarding performance, safety, or fitness for a particular purpose.

The Renter agrees to release Flamenco Beach Club, Culebra Beach Villas, property owners, hosts, managers, staff, and affiliates from any liability, claims, injuries, losses, or damages arising from the use of rented equipment.

9. Beach Umbrella Safety Notice

Beach umbrellas can be dangerous if not used properly, especially in windy conditions.

The Renter agrees to:

• Secure the umbrella properly before use.
• Never use umbrellas during strong winds.
• Close and remove umbrellas when leaving the beach.
• Never leave umbrellas unattended.
• Accept full responsibility for any injury or damage caused by improper use.

Flamenco Beach Club reserves the right to refuse or discontinue umbrella rentals during unsafe weather or wind conditions.

Important: All rental equipment, including umbrellas, chairs, cabanas, and coolers, must be removed from Flamenco Beach at the end of each day. Overnight storage on the beach is strictly prohibited due to environmental regulations and sea turtle nesting protections.

10. Sales Tax and Fees

Applicable taxes, service fees, delivery fees, processing fees, or other charges may be added at checkout when required.

11. Privacy

Personal information collected during booking will be used only to process the rental, verify guest eligibility, communicate about the order, prevent fraud, and complete delivery or pickup.

Information will not be sold or shared with unrelated third parties.

12. Electronic Communication Consent

By placing an order or contacting Flamenco Beach Club, the Renter agrees to receive communications by email, text message, phone call, or booking platform message regarding their rental.

13. Changes to Terms

Flamenco Beach Club may update these Terms & Conditions at any time. The version posted on the website at the time of booking will apply to the rental.

14. Agreement

By completing a reservation through FlamencoBeachClub.com, the Renter confirms:

I have read, understood, and agree to the Terms & Conditions of Flamenco Beach Club. I understand this service is available only to registered guests staying at Culebra Beach Villas and is not available to the general public or at the public Flamenco Beach Balneario.

This writing contains and constitutes the entire agreement between the parties.
